Prayer : Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus directing the second and third respondents herein to survey and measure the petitioner's property comprised in Survey Number 465/12C, extent in 7 Ares (17 1⁄4 Cent) situated at Suriyur Village, Viralimalai Taluk, Pudukkottai District and consequently fourth and fifth respondents herein to provide adequate police protection to the petitioner's property on the basis of the petitioner's representation dated 28.12.2025 within the time stipulated by this Court.

O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second and third respondents herein to survey and measure the petitioner's property comprised in Survey No.465/12C, measuring an extent of 7 Ares (171⁄4 cents), situated at Suriyur Village, Viralimalai Taluk, Pudukkottai District and consequently directing the fourth and fifth respondents herein to provide adequate police protection Page No. 2 of 6

for conducting the said survey, based on the petitioner's representation dated 28.12.2025, within the time to be fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner would submit that an online application has been submitted for the survey of the property in question and for demarcation of its boundaries and also a representation has also been submitted.

4. The learned Additional Government Pleader appearing for the first to third respondents would submit that there are rival parties and that however, after consideration of the claims of the parties, proper steps would be taken to survey and demarcate the land in question in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

5. Recording the aforesaid submissions, this Court directs the second and third respondents to consider the online application of the Page No. 3 of 6

petitioner dated 24.07.2024 and his representation dated 28.12.2025, survey and demarcate the petitioner's land after consideration of the claims of all parties, including the private respondent and rival parties and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of sixteenth weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the Civil Court. It is needless to state that before surveying the land, notice shall be issued to the adjacent landowners and other interested parties, if any and that if required, police assistance may be taken.

6. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
