2. Heard the learned counsel for the petitioner and perused the materials available on record.

3. Considering the facts and circumstances of the case, this Court is not inclined to set aside the proceedings as sought for by petitioner. Hence, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petition is closed. However, all the issues are left open to be raised before the Court below.
