O R D E R
This Criminal Original Petition has been filed to direct the second respondent, to register the case based on the complaint given by the petitioner dated 08.11.2018.
2.Heard Mr.K.Kulanthai Vikram, the learned counsel appearing for the petitioner and Mr.Prabu Ramachandran, the learned Government Advocate (Crl.Side) appearing for the respondents. 3.The learned counsel appearing for the petitioner has submitted that the petitioner gave a sum of Rs.47 lakhs, to the proposed accused for supplying rice, but the proposed accused has https://hcservices.ecourts.gov.in/hcservices/
supplied rice only for a sum of Rs.37,27,360/-. But he failed to supply for the balance amount of Rs.10,62,610/- and hence, the petitioner has lodged a complaint before the second respondent on 08.11.2017. The second respondent has forwarded the said complaint, to the third respondent on 05.02.2018, directing the third respondent to enquire the matter and if the enquiry reveals any cognizable offence, then he has to register a case and submit report within a week, but sofar, no action has been taken by the third respondent.
4.The learned Government Advocate (Crl.side) has submitted that enquiry is still pending before the third respondent. 5.Considering the aforesaid submissions, the third respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence, then he has to register a case and proceed further in accordance with law, within a period of one week from the date of receipt of copy of this order.
6.With the aforesaid observations, this Criminal Original Petition is disposed of.
