PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India, praying to set aside the Fair and Decreetal order passed in R.L.T.A. No.02 of 2024, on the file of the Rent Control Appellate Authority (3rd Additional District Court, Tirunelveli), dated 04.10.2024, confirming the Fair and Decreetal order passed in R.L.T.O.P.No.10 of 2021, on the file of the Rent Controller (1st Additional District Munsif), Tirunelveli dated 06.01.2023 by allowing this Civil Revision Petition.

This petition has been filed seeking to set aside the Fair and Decreetal order passed in R.L.T.A.No.02 of 2024, on the file of the Rent Control Appellate Authority (3rd Additional District Court, Tirunelveli), dated 04.10.2024, confirming the Fair and Decreetal order passed in R.L.T.O.P.No.10 of 2021, on the file of the Rent Controller (1st Additional District Munsif), Tirunelveli dated 06.01.2023.
2.Learned Counsel for the petitioner would submit that the petitioner is a tenant and he suffered an order of eviction both before the Rent Controller as well as before the appellate authority. He further submits that the petitioner agrees to evict the premises within the time to be stipulated by this Court and filed an affidavit to that effect before this Court. 3.The respondents Counsel has no serious objection for the same. 2/5
4.In view of the subsequent developments and in view of the affidavit filed by the petitioner, the petitioner is directed to vacate and hand over the premises on or before 30.10.2025, and hand over possession to the respondents / landlords, failing which the respondents / landlords are at liberty to approach the jurisdictional police to carry out the eviction. If such request is made by the respondents, the jurisdictional police shall evict the petitioner and hand over possession to the respondents / landlords. In the meanwhile, the petitioner is directed to pay the admitted rend to the respondents / landlords. 5.The affidavit filed by the petitioner shall form part of the records. 6.Accordingly, this Civil Revision Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
