This Criminal Original Petition has been filed to direct the second respondent, to register a case based on the complaint given by the petitioner dated 17.12.2016.
2.Heard Mr.T.Vadivelan, the learned counsel appearing for the petitioner and Mr.Prabu Ramachandran, the learned Government Advocate (Crl.Side) appearing for the respondents. 3.The learned counsel appearing for the petitioner has submitted that the proposed accused namely Gnanadurai is working as a teacher in the Government School at Sayalkudi, Ramanathapuram District. He further submitted that the said Gnanadurai gave a false promise by saying that if the petitioner has paid a Sum of Rs.85,000/-, he would make arrangement for getting clerk post in the said school and on believing his words, the petitioner has paid a sum of Rs.85,000/-, but subsequently, the said Gnanadurai did not make any arrangement for getting job and also refused to https://hcservices.ecourts.gov.in/hcservices/
return the money. Hence, the petitioner has lodged a complaint before the second respondent on 17.12.2016. But sofar, no action has been taken.
4.The learned Government Advocate (Crl.side) has submitted that enquiry is still pending.
5.Considering the aforesaid facts, the second respondent is directed to expedite the enquiry with regard to the complaint dated 17.12.2016, if the enquiry reveals any cognizable offence, then he has to register a case and proceed further in accordance with law, with in a period of one week from the date of receipt of a copy of this order.
6.With the aforesaid observations, this Criminal Original Petition is disposed of.
