ORDER

This Criminal Original Petition is filed to direct the District and Sessions Judge, Special Court for SC/ST (POA) Act Cases, Theni under SC/ST Prevention of Atrocities Act to consider the Bail application of the petitioner on the same day in the event of her surrender in connection with Crime No.301 of 2024 pending investigation on the file of the 2nd Respondent police on merits on the same day.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. The case of the prosecution is that the accused No.1 was rearing cattle on the agricultural field owned by the defacto complainant's mother without their permission. On 10.07.2024, when the defacto complainant confronted the accused No.1, he abused the defacto 2/4

complainant with filthy language about her caste. Based on these allegations, an FIR has been registered against the petitioner.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned District and Sessions Judge, Special Court for SC/ST (POA) Act Cases, Theni, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.301 of 2024 on the file of the 2nd respondent police.
