ORDER
This Criminal Original Petition has been filed to direct the second respondent to register a case based on the complaint given by the petitioner dated 06.11.2017.
2.Heard Mr.M.Jagadeesh Pandian, learned counsel appearing for the petitioner and Mr.Prabhu Ramachandran learned Government Advocate (Crl.Side) appearing for the respondents. 3.The learned counsel appearing for the petitioner has submitted that the petitioner's husband has borrowed loan from several persons and he has filed an Insolvency Petition in I.P.No.20 of 2013 on the file of the learned Additional District Munsif Court, Dindigul and left his family. He further submitted that the petitioner has filed a Divorce Petition in HMOP.No.171 of https://hcservices.ecourts.gov.in/hcservices/
2014, on the file of the Family Court, Dindigul and the same is also pending and that being so, one Jeyaraman, who was working under the petitioner's husband has stealthily taken three cheque leaves of the petitioner and forged the petitioner's signature and filed a case under Section 138 of Negotiable Instruments Act. He further submitted that when the said Jeyaraman and others have criminally intimiated the petitioner and also abused her and hence the petitioner has lodged a complaint before the second respondent on 06.11.2017, but sofar, no action has been taken. 4.The learned Government Advocate (Crl.Side) appearing for the respondents has submitted that after receipt of the complaint enquiry has been conducted and the same was closed on 30.11.2017, as the dispute is civil in nature.
5.Recording the aforesaid submissions, this Criminal Original Petition is disposed of. It is open to the petitioner to avail any other remedy which is available under the law. Sd/- Assistant Registrar(W) /True Copy/ Sub Assistant Registrar To
