ORDER

This Criminal Original Petition has been filed to direct the respondents to register a case based on the complaint given by the petitioner dated 01.09.2017.

2.Heard Mr.R.Thangapandian, learned counsel appearing for the petitioner and Mr.Prabhu Ramachandran learned Government Advocate (Crl.Side) appearing for the respondents.

3.The learned counsel appearing for the petitioner has submitted that one Maheswari and her family conducted unregistered chits. The petitioner has joined in that chits and paid a sum of Rs.2 lakhs, but subsequently, the said Maheswari refused to return the money and when the petitioner made demand to repay the amount, the said Maheswari has paid only a sum of Rs.40,000/-, but refused to pay the balance amount of Rs.1,60,000/- and hence, the petitioner has lodged a complaint before the second respondent on 01.09.2017, but sofar, no action has been taken.

4.The learned Government Advocate (Crl.Side) appearing for the respondents has submitted that after receipt of the complaint, enquiry has been conducted and the same was closed, as the dispute is civil in nature.

5.Recording the aforesaid submissions, this Criminal Original Petition is disposed of. It is open to the petitioner to avail any other remedy which is available under the law.
