ORDER

(Order of the Court was made by PUSHPA SATHYANARAYANA, J.) The writ petition is filed for a Mandamus, directing the Respondents not to open the TASMAC Shop No.6550 in Survey Nos. 1184C2A and 1184C2B at Keeramangalam Village, Alangudi Taluk, Pudukkttai District.

The petitioner has raised several objections stating that the said shop is situate near a School and there was a public protest earlier for housing the said shop in the residential area. 3.

The learned counsel appearing for the 2nd respondent would submit that earlier where the said shop was housed, was in a https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.1120 of 2022 dilapidated condition and the same was closed which was recorded in W.P(MD)No.20957 of 2021 dated 24.11.2021. It is stated that in the very same place, the owner of the land is constructing a shop and the proposal for housing the said TASMAC shop has already been sent to the District Collector, Pudukkottai. It is only after the approval is given by the District Collector, the shop can be run. 4.

Thus, if the petitioner is so aggrieved, it is open to the petitioner to send his objections to the 1st respondent / District Collector, Pudukkottai, who may consider the objections of the petitioner before giving approval to the 2nd respondent. 5.
