PRAYER: Writ Petition is filed under Article 226 of Constitution of India to issue a Writ of Mandamus, directing the second respondent to sub divide and issue separate Patta in respect of survey numbers 182/2, 182/3, 182/4 and 183/3 for an extent of 0.67.0, 0.76.0, 0.81.5, and 0.82.0 Hectors are situated at Palayamkottai Village, Manapparai Taluk, Trichy District on the basis of Petitioner's representation dated 19.12.2024 within time frame fixed by this Court.

ORDER

This Writ Petition is filed for writ of mandamus directing the second respondent to subdivide and issue separate Patta in respect of 1/5

survey numbers 182/2, 182/3, 182/4 and 183/3 to an extent of 0.67.0, 0.76.0, 0.81.5, and 0.82.0 hectares in Palayamkottai Village, Manapparai Taluk, Trichy District, on the basis of petitioner's representation dated 19.12.2024 within time frame to be fixed by this Court.

2. With consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

The subject properties in Survey Nos.182/2, 182/3, 182/4 and 183/3 to an extent of 0.67.0, 0.76.0, 0.81.5, and 0.82.0 hectares in Palayamkottai Village, Manapparai Taluk, Trichy District, originally belonged to the petitioner's father. The petitioner's father executed a settlement deed on 24.09.2008, settling the properties in favour of the petitioner and his brother. A joint patta was issued in favour of the petitioner and his brother for the subject properties. The petitioner approached the second respondent to subdivide his lands and to issue separate patta to him and also made an online application on 20.11.2024. The petitioner's application was kept pending without any progress. The petitioner sent a detailed representation on 19.12.2024 to the respondent. Even thereafter no action was initiated. The petitioner hence filed the 2/5

above writ petition for the aforesaid relief.

4. The learned Government Advocate, on instructions, submits that survey of the lands has already been conducted and steps are being initiated to subdivide and to issue separate patta to the petitioner. The learned Government Advocate therefore seeks reasonable time for completing the process.

5. In view of the submissions made by the learned Government Advocate, a direction is issued to the second respondent to complete the process and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 22.01.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No CM 3/5
