ORDER

This Criminal Original Petition has been filed to direct the second respondent to register a case based on the complaint given by the petitioner dated 20.06.2018.

2.Heard Mr.T.M.Madasamy, learned counsel appearing for the petitioner and Mr.Prabhu Ramachandran learned Government Advocate (Crl.Side) appearing for the respondents.

3.The learned counsel appearing for the petitioner has submitted that the petitioner entered into an agreement with one Rajkumar and Subramaniyan for running two shops and in pursuance of the said agreement, the petitioner has paid a sum of Rs.1,70,000/- to the aforesaid persons on 23.04.2018 and subsequently, lease period was extended. He further submitted that since the aforesaid persons tried to evict the petitioner from the aforesaid shops, the petitioner has filed a suit in O.S.No.365 of 2011 on the file of the learned District Munsif Court, Manapparai and also obtained interim injunction. Thereafter, the aforesaid persons broken the locks of https://hcservices.ecourts.gov.in/hcservices/

the two shops and took all the materials worth about Rs.3 lakhs and Rs.5,000/- cash. Hence, the petitioner has lodged a complaint before the second respondent on 20.06.2017, but sofar, no action has been taken.

4.The learned Government Advocate (Crl.Side) appearing for the respondents has submitted that enquiry is still pending. 5.Considering the fact that the complaint was lodged by the petitioner on 20.06.2017 and the complaint is still pending for past nearly 9 months, the second respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence, then he has to register a case and proceed further in accordance with law, within a period of one week from the date of receipt of a copy of this order.

6.With the aforesaid observations, this Criminal Original Petition is disposed of.
