PRAYER : Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first respondent to take necessary action against the fifth respondent, pursuant to the report dated 30.05.2018 in Na.Ka.No.4570/2018/C4 submitted by the fourth respondent within a stipulated time fixed by this Court. This Writ Petition has been filed seeking for a direction to the first respondent to take necessary action against the fifth respondent, pursuant to the report, dated 30.05.2018 in Na.Ka.No.4570/2018/C4 submitted by the fourth respondent within a stipulated time fixed by this Court.
2. It appears that the petitioner is having a dispute with the fifth respondent who was conducting a brickkiln and the petitioner has submitted a representation to the first respondent for taking appropriate action based on the inspection report of the fourth respondent, namely, the Tahsildar, Palani Taluk, Dindigul District, dated 30.05.2018. 2/5

The learned Special Government Pleader appearing for the respondents 1 to 4 submits that there is a civil dispute pending between the petitioner and the respondent No.5 and the fifth respondent was conducting a brickkiln and was permitted to store the soil to an extent of 387 units. However, at the time of inspection, he was found in possession of 1428.25 units, for which, notice has been issued as per the Tamil Nadu Prevention of Illegal Mining, Transportation and Storage of Minerals and Mineral Dealers Rules, 2011 and the fifth respondent has also paid a penalty of Rs.50,000/- (Rupees Fifty Thousand only). She further submits that the license granted to the fifth respondent for conducting brickkiln has not been extended further.
4. Recording the submission made by the Special Government Pleader appearing for the respondents 1 to 4, this Writ Petition is closed. There shall be no order as to costs.
