ORDER : The Court Made the following order :- The petitioner who is arrayed as A1, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 498-A IPC, Section 4 of TNPWH Act and Section 4 of Dowry Prohibition Act, in Crime No.07 of 2012 on the file of the respondent police and hence, seeks anticipatory bail, in pursuance of the Non-Bailable Warrant issued by the learned Judicial Magistrate, Uthamapalayam.
2. The learned Counsel appearing for the petitioner submits that the petitioner was not aware of the case filed against him and the respondent has filed the final report showing the petitioner as absconding accused. He further submits that the other accused were already granted anticipatory bail by this Court in Crl.O.P(MD)No.16683 of 2012 on 28.11.2012.
3. The learned Government Advocate (Criminal side) appearing for the respondent submits that except this petitioner the other accused are appearing before the learned Judicial Magistrate, Uthamapalayam.
4. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate (Criminal side) appearing for the respondent.
5. Considering the fact, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.
6. Accordingly, the petitioner is ordered to be released on bail in the event of his arrest or on his appearance before the learned Judicial Magistrate, Uthamapalayam, on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition https://hcservices.ecourts.gov.in/hcservices/
that the petitioner shall appear before the learned Judicial Magistrate, Uthamapalayam for all future hearings in P.R.C.No.295 of 2013 without fail. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
7.
