The second appeal against the judgment and decree dated 19.11.2002 in A.S.No.138/1996 passed by the Subordinate Judge, Padmanabhapuram confirming the Judgment and Decree dated 25.06.1996 in O.S.No.304/1996 of the Additional District Munsif Court, Padmanabhapuram.
ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S. R.MURUGAN, Advocate for the petitioner and the court made the following order:- The petition in C.M.P.(MD)No.5235 of 2016 is filed to condone the delay of 2406 days in filing the petition to set aside the abatement caused due to the death of the 2nd respondent in S.A. (MD)No.1251 of 2003.
2. Having satisfied with the reasons stated in paragraph No.4 of the affidavit filed in support of this petition, the delay is condoned on condition that the petitioners shall deposit a sum of Rs.5,000/- (Rupees five thousand only) to the respondents or to their counsel either by cash or by way of Demand Draft within a period of two weeks from the date of receipt of a copy of this order. This petition is ordered accordingly.
