ORDER
The Criminal Original Petition has been filed to transfer the case in Cr.No.41 of 2018 pending investigation by the fourth respondent.
2.The learned counsel submitted that he has been hugely cheated by the three accused persons, who have the political back-ground in the State. He also submitted that some amount was paid as processing charges to the accused persons for a loan, however, the accused person neither have given loan to the petitioner nor have repaid the amount. Hence, he preferred a complaint before the fourth respondent. Since the investigation has not made any headway, the present petition is now filed to transfer the investigation.
3.When the matter was taken up for hearing on last occasion, this Court directed the fourth respondent to file his status report. Today, i.e. on 06.03.2019, the fourth respondent filed a status report. Paragraph six of the status report states that three accused have been moved this Court seeking anticipatory bail and this Court directed all the three accused to deposit a sum of Rs.75,00,000/- in the trial Court and the petitioner herein directed to withdraw the said amount, after presenting necessary bank guarantee.
4.The learned counsel for the petitioner submitted that to the knowledge of the petitioner, money is yet to be deposited. He further submitted that the accused has cheated several persons and 10 cases are reported to file across the different Districts. 5.The Superintendent of Police / third respondent is directed to consider such investigation as to the involvement of the accused persons in cases pending in other Districts and if it so, the matter may be referred to C.B.C.I.D. and he may take steps to transfer the same.
6.The Superintendent of Police / third respondent is further directed to issue summons to the petitioner by fixing time and date, for such enquiry and also granting adequate time to appear before him. Accordingly, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petition is closed.
