ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded to judicial custody on 07.12.2024 for the offences under Sections 318(4) BNS Act 2023 and Section 66(D) of 1/3

Information Technology Act in Crime No.40 of 2024 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner has contacted the defacto complainant to invest in online trading. The defacto complainant also trusted and invested a sum of Rs.18,12,471/- in various installments. But she did not receive any profit and she is unable to withdraw her investments. Based on the complaint of the defacto complainant, the present case was registered. 3.The learned Counsel for the petitioner stated that the petitioner is not involved in any offence and he only opened an account and no amount has been transferred in his name.

4.The learned Additional Public Prosecutor appearing on behalf of the State strongly objected to grant bail to the petitioner by stating that huge amount has been involved in this case and the petitioner alone opened the account in order to facilitate the other accused to transfer money and five accounts have been so far opened and the respondent police is unable to trace out the amount and so far, only two accounts were traced out. He further stated that the amount, which was involved in the crime could not be recovered and they need to investigate further. 5.Taking into consideration of the fact that huge amount has been involved in this case and if the petitioner is released on bail, there is a chance for absconding, 2/3
