ORDER

Seeking to direct the 3rd respondent police not to harass the petitioner and his family members under the guise of inquiry, this criminal original petition is filed.

2. On the complaint received from the 4th respondent, the petitioner is continuously subjected to harassment in a civil matter and sought the indulgence of this Court.

The learned counsel for the petitioner drew my attention to the order passed by this Court in C.M.P(MD)No.5848 of 2025 in C.M.A(MD)No.330 of 2025, dated 03.04.2025, in which ex parte order which has been obtained by the 4th respondent as against the petitioner has been set aside and vacated. Despite the same, in a pending civil matter, the police is meddling. Hence, this petition. 2/5

Per contra, the learned Government Advocate(Crl.Side) submitted that originally the 4th respondent borrowed money from the petitioner and for the purpose of security, he had executed a sale deed in favour of the petitioner subject to the condition not to alienate the same till the settlement of the said amount. In the meanwhile, the petitioner executed sale agreement to some other person. In this regard, a civil suit is also pending. Pending civil suit, the petitioner is trying to construct a house.

5. The submission of the learned Government Advocate(Crl.Side) would reveal that the dispute involved is nothing but a civil dispute. Hence, the 3rd respondent police is directed not to meddle in the civil dispute pending between the petitioner and the 4th respondent and the 4th respondent shall be advised to approach the appropriate Civil Court to work out his remedy.

6. With the above directions, this Criminal Original Petition stands disposed of.
