A.Raman v. The State Of Tamil Nadu

2026-02-13Honourable Mrs Justice N. Mala3 pages

in Crl.A(MD)SR.No.53285 of 2025 N.MALA, J.

This petition has been filed to condone the delay of 18 days in filing the above criminal appeal against the judgement in Cr.M.P.No.984 of 2024, dated 23.06.2025, on the file of the Special Court/Schedule Caste and the Schedule Tribers, Kanyakumari at Nagercoil. 2.Aggrieved by the order dated 23.06.2025 passed in Cr.M.P. No. 984 of 2024 dismissing his protest petition, the petitioner has preferred the present appeal.

3.The petitioner states that his counsel inadvertently preferred revision instead of a criminal appeal before this Court. Due to that reason, there is a delay of 18 days in filing the appeal. The delay was neither wilful nor wanton.

4.Being satisfied with the reasons stated in the affidavit, this Court is inclined to condone the delay of 18 days, giving an opportunity to the petitioner to contest the statutory appeal on merits. 1/3

5.Accordingly, the delay of 18 days in filing the criminal appeal is condoned. The petition is ordered. Registry is directed to number the appeal, if it is otherwise in order and list the case for admission. 13.02.2026 sn 2/3
