PRAYER: Petition is filed under Section 482 of Code of Criminal Procedure, to direct the learned District Munsif Cum Judicial Magistrate, Eraniel, Kanyakumari District, to dispose of the C.C.No.255 of 2015 within stipulated time as fixed by this Court. O R D E R

This petition has been filed by the accused Nos.1 to 3 to direct the learned District Munsif-cum-Judicial Magistrate, Eraniel, Kanyakumari District to dispose of the case in C.C.No.255 of 2015 at early.

2.The learned counsel for the petitioners has submitted that the petitioners are facing trial for the offences under Sections 294(b), 323, 324, 506(ii) IPC. Though the above case was taken on file in the year 2015 and the accused also regularly appearing before the Trial Court, there is no progress in the above case. Hence, he requests to direct the concerned District Munsif-cum-Judicial Magistrate to dispose of the above said case at early.

3.The learned Government Advocate has submitted that totally nine witnesses have been cited and the learned District Munsif-cum-Judicial Magistrate has issued summons to the witnesses https://hcservices.ecourts.gov.in/hcservices/

1 to 5 for hearing, dated 04.04.2018 and hence, he request to fix some reasonable time for disposal of the aforesaid case. 4.considering the aforesaid submissions, the learned District Munsif-cum-Judicial Magistrate, Eraniel, Kanyakumai District is directed to expedite the trial in C.C.No.255 of 2015 and dispose of the same within a period of six months from the date of receipt of a copy of this order. The respondent is directed to produce the witnesses before the Trial Court, without seeking un-necessary adjournments and if the witnesses are produced, the petitioners should cross-examine them on the same day and they should not seek adjournment.

5.With the aforesaid observation, the criminal original petition is disposed of.
