O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first to third respondents to consider the petitioner's representation dated 05.09.2025.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The grievance of the petitioner is that the petitioner belongs to a Scheduled Caste community. The land comprised in Survey No.1275, measuring an extent of 15 acres, situated at Kadamalaikundu Village, Theni District, originally belonged to one N.R. Parthiban, who acquired the same by inheritance.

4. Though the said N.R. Parthiban has acquired the same, the petitioner and her family members have been residing on the said land by Page No. 2 of 6

constructing a house, paying house tax and cultivating the land for more than 25 years. Apart from that, the said N.R.Parthiban received a sum of about Rs.5 lakhs from the petitioner and entered into an agreement with the petitioner's family.

In the year 2000, certain Government officials visited the petitioner's house and assured that land title would be granted in respect of the said 15 acres in favour of the petitioner's family members. However, patta was erroneously granted in favour of one Kaliamadan, Ayyammal, Rasathi, and Vellaiyammal, who are in no way connected to the petitioner's family and have never been in possession of the subject land. Even thereafter, the petitioner's family has continued to reside on the land and cultivate the same.

6. Therefore, the petitioner submitted a representation dated 05.09.2025 to the first to third respondents seeking issuance of patta in the name of the petitioner's family members. However, no action has been taken on the petitioner's representation. Hence, the petitioner has been constrained to file the present Writ Petition. Page No. 3 of 6

7. The learned Additional Government Pleader appearing for the respondents, on instructions, would submit that the petitioner's representation dated 05.09.2025 would be considered and appropriate orders would be passed by the third respondent within a period of sixteen weeks.

8. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 05.09.2025 and pass appropriate orders on its merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The third respondent is also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order.
