ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1 in Crime No.196 of 2015 on the file of the respondent police, was arrested on 06.06.2015 for the alleged offences punishable under Sections 174 @ 306 of I.P.C. and hence, seeks bail.
2. The case of the prosecution is that the first accused / the petitioner herein had married the daughter of the de-facto complainant about 9 years ago and they were residing at Tirupur and during the wedlock, they have two children and the accused have been demanding more dowry from the deceased and on 05.06.2015, the deceased committed suicide by hanging.
3. The learned counsel for the petitioner submitted that the petitioner is no way connected with the offence and the complaint was given only on suspicion. It is further submitted that he has been incarceration for more than 50 days and no one is there to take care of two children.
4. The learned Government Advocate (Crl.side) submitted that due to the dowry harassment by the accused, the deceased committed suicide on https://hcservices.ecourts.gov.in/hcservices/ 05.06.2015 and the accused 2 to 4 are still absconding.
5. However, considering the fact that the petitioner has been incarceration since 06.06.2015, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Melur, Madurai District and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m. until further orders.
