Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The Petitioners, who are arrayed as A1 to A2, apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b),323,324 and 506(ii) I.P.C. In crime No.172 of 2015 on he file of the respondent police and hence, seek anticipatory bail.
2. The case of the prosecution is that on 09.07.2015 at about 13.00 Hours the petitioners had entered into a wordy quarrel with the de-facto complainant and abused in filthy language and assaulted her.
3. The learned Counsel appearing for the petitioners submits that the petitioners and the de-facto complainant are neighbours and it was only a wordy quarrel arose between them. He further submits that the petitioners are innocent and they have been falsely implicated in this case.
4. It is submitted by the learned Government Advocate (Crl.side) that the injured person had already been discharged from the hospital.
5. Considering the submissions made by the learned Government Advocate (Crl.side) and also considering the fact that the injured person had already been discharged from the hospital, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions.
6. Accordingly, the petitioners are ordered to be released on bail in the event of their arrest or on their appearance before the learned Judicial Magistrate, Sengottai, and each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent https://hcservices.ecourts.gov.in/hcservices/
police daily as and when required. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C Scrupulously.
7.
