ORDER : The Court Made the following order :- The petitioner who is arrayed as A1, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 457 and 380 IPC, in Crim No.197 of 2014 on the file of respondent police and hence, seeks anticipatory bail.
2. According to the de-facto complainant, on 23.07.2014, somebody trespassed into the house and stolen of 5 sovereign of gold chain. Hence a case has been registered.
3. The learned Counsel appearing for the petitioner submitted that the case has been registered on 24.07.2014 and the father and brother of the petitioners were arrested in Crime No.128 of 2015 and remanded to judicial custody on 23.05.2015. They issued notice through Counsel on 30.05.2015 to the respondent claiming compensation of Rs.5,00,000/- for illegal detention. Only thereafter, the entire family members of the petitioner were implicated in this case and the father and brother were arrested and remanded to judicial custody. The petitioner is working in Chennai.
4. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent.
5. Considering the submissions made by the learned Counsel, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.
6. Accordingly, the petitioner is order to be released on bail in the event of his arrest or on his appearance before the learned Judicial Magistrate No.I, Kuzhithurai, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on https://hcservices.ecourts.gov.in/hcservices/
further condition that petitioner shall appear before the learned Judicial Magistrate No.I, Kuzhithurai, daily at 10.00 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
