Respondents PRAYER:Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of mandamus, directing the respondents to depute officials to make local inspection on the land in Survey No.539/1A, situated at Vijayanarayanam village, Thisayanvilai Taluk, Tirunelveli District which was sold to the Government of Tamil Nadu as per the Registered sale deed in document number 1611 / 2019 dated 20.08.2019, on the file of the Sub Registrar Thisayanvilai consequently, direct the respondents to pay appropriate compensation by calculating the number of trees situated in the subject land.

ORDER

The prayer in nutshell in this writ petition is to conduct inspection of the subject property and pay appropriate compensation .

2.In response to the notice issued by this Court, the second respondent has filed a counter affidavit. In the counter affidavit, paragraph No.5, it has been stated as follows:

5. ... ... ... As per Government norms, we have fixed the compensation amount to the trees which were found in Survey No.539/1A situated at Vijayanaranan village, Thisayan taluk, Tirunelveli District. Now we have inspected the land belongs to the petitioner. After getting permission from the 1st respondent, we are ready to give balance compensation amount to the petitioner under river water connection scheme with government norms."

W.P(MD)No.1575 of 2021 3.In view of the above statement made in the counter affidavit filed on behalf of the second respondent, no further adjudication is required in this writ petition. Therefore, the writ petition stands disposed of. No costs.
