ORDER
This petition has been filed to direct the second respondent to register the First Information Report based on the complaint given by the petitioner dated 12.12.2017.
2.The learned counsel for the petitioner has submitted that the proposed accused has pledged some Gold plated jewels (Gold covering Jewels) and obtained a sum of Rs.3,96,000/- as loan and it was found that those jewels are not genuine jewels. Hence, a complaint was lodged before the second respondent on 15.03.2016 and the same was closed on 16.03.2016 and no action was taken and hence, another complaint was lodged on 12.12.2017 and in that complaint also, no action was taken.
3.The learned Government Advocate (Crl.side) has submitted that based on the complaint, dated 15.03.2016, CSR.No.54 of 2016 was issued and during the enquiry, both the complainant and the proposed accused appeared and the complainant has stated that the proposed https://hcservices.ecourts.gov.in/hcservices/
accused has paid the entire amount to the Bank and hence, no further action need to be taken on the said complaint. Considering the aforesaid statements, the said complaint was closed. He further submitted that subsequently, the petitioner herein, has lodged another complaint on 12.12.2017 and the same is still pending. 4.Considering the aforesaid submission, the second respondent is directed to enquire the matter and dispose of the same in accordance with law, within a week from the date of receipt of a copy of this order.
5.With the aforesaid observation, the Criminal Original Petition is disposed of.
