PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to direct the respondents 1 to 3 not to harass the petitioner on the basis of the N.B.W issued has against the petitioner on 14.12.2017 due to his absent which was related on 07.02.2018 recalled by the Trial Court(Fast Tract Court) (Judicial Magistrate Level), Theni, on basis of the surrender of the petitioner before the said Court.

ORDER

This Criminal Original Petition has been filed seeking for a direction the respondents 1 to 3 not to harass the petitioner on the basis of the N.B.W issued as against the petitioner on 14.12.2017 due to his absent which was on 07.02.2018 recalled by the Trial Court(Fast Tract Court) (Judicial Magistrate Level), Theni, on the basis of his surrender before the said Court. 2.Heard the learned Counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 to 3.

3.The learned Additional Public Prosecutor appearing for the respondent police submits that a Non Bailable Warrant is pending against the petitioner issued by the competent Court in Section 138 of the Negotiable Instruments Act proceedings. The respondent police are in the process of executing the Non Bailable Warrant. Therefore, there is no scope for entertaining this petition. 4.Accordingly, the Criminal Original Petition is dismissed.
