RESPONDENT/PETITIONER/APPELLANT Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to permit the petitioner to withdraw the amount of Rs.2,00,000/- which was deposited by the Respondent before the III Additional SubCourt, Madurai as per the order of this Honourable Court in CMP.No.3453 of 2016 in CMSA.No.10 of 2016.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.T.C.S.THILLANAYAGAM, Advocate for the petitioner and of Mr.V.GEORGE RAJA, for M/S.AJMAL ASSOCIATES on behalf of the Respondent, the court made the following order:- This petition is filed to permit the petitioner to withdraw the amount of Rs.2,00,000/- which was deposited by the respondent before the III Additional Sub Court, Madurai as per the order of this Court in C.M.P(MD)No.3453 of 2016 in C.M.S.A(MD)No.10 of 2016. 2.The learned counsel appearing for the respondent has no objection to withdraw the amount of Rs.2,00,000/- without prejudice to the arguments in the main appeal and he has also made an endorsement to that effect.

3.Recording the no objection made by the learned counsel for the respondent, this petition is ordered and the petitioner is permitted to withdraw a sum of Rs.2,00,000/- which was deposited by the respondent before the III Additional Sub-Court, Madurai as per the order of this Court in C.M.P(MD)No.3453 of 2016. sd/- 13/03/2017 / TRUE COPY / Sub-Assistant Registrar (C.S.)
