PRAYER :- For Bail in Crime No.1091 of 2019 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A7 herein was arrested and remanded to judicial custody on 13.11.2019, for the offence under Sections 147, 148, 149, 342, 294(b), 324, 302, 506(ii), 114 and 34 of IPC, in Crime No.1091 of 2019 on the file of the respondent Police, seeks bail. 2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent Police.

3.The learned Additional Public Prosecutor appearing for the respondent Police submitted that the totally there are seven accused in this case, in which, the petitioner has been arrayed as A7. He further submitted that in this case investigation has been completed and final report has been filed and the same has been taken on file in S.C.No.65 of 2020 by the VI Additional Sessions Judge, Madurai. 1/3

He further submitted that the petitioner is having 16 previous cases, out of which, 11 cases are still pending and the petitioner is a rowdy element and he is a history sheeter. 3.It is seen that there are 16 previous cases pending against the petitioner, in which, five cases disposed of and 11 cases are still pending. It is also seen that the petitioner is a rowdy element and he is a history sheeter.

4.Considering the facts and circumstances of the case and also considering the fact that the petitioner is having 16 previous cases and he is a history sheeter involving various offences from the year 2013 and he is a rowdy element, this Court is not inclined to grant bail to the petitioner.

5.At this juncture, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition. 6.In view of the above, this criminal original petition stands dismissed as withdrawn. However, the trial Court is directed to conduct the trial on day to day basis and complete the trial within a period of six months from the date of receipt of a copy of this order.
