Mr.S.Manikandan, Government Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. PRAYER : FOR ANTICIPATORY BAIL IN CRIME NO. 5 OF 2024 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent Police for the alleged offence under Sections 393 and 397 of IPC in Crime No.5 of 2024, seek anticipatory bail.

2. The case of the prosecution is that the petitioner and other accused 1/3

persons intercepted the defacto complainant and another and snatched 3kgs of gold from them. When the defacto complainant tried to prevent them, he was assaulted by the accused persons. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and the petitioner has no role in this case and at that time of occurrence, he was in his mobile shop at Chennai. He was falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned counsel for the Government Advocate (Crl.Side) would submit that the stolen articles were not recovered from the accused persons.

5. Considering the facts and circumstance of this case and also considering the fact that the stolen articles were not recovered from the accused persons, I am not inclined to grant anticipatory bail to the petitioner.
