PRAYER: Civil Revision Petition under Section 25 of the Tamil Nadu Buildings [Lease and Rent Control Act, 1960], to set aside the fair and decreetal order passed in R.C.A.No.13 of 2019 on the file of the learned Rent Control Appellate Authority (Principal Subordinate Judge), Tirunelveli, dated 28.07.2020 reversing the fair and decreetal order passed in R.C.O.P.No.17 of 2016 on the file of the learned Principal Rent Controller (Principal District Munsif Court), Tirunelveli dated 03.06.2019 and allow the present Civil Revision Petition.

ORDER

This Civil Revision is filed to set aside the fair and decreetal order passed in R.C.A.No.13 of 2019 on the file of the learned Rent Control Appellate Authority (Principal Subordinate Judge), Tirunelveli, dated 28.07.2020 reversing the fair and decreetal order passed in R.C.O.P.No.17 of 2016 on the file of the learned Principal Rent Controller (Principal District Munsif Court), Tirunelveli dated 03.06.2019.

2.Heard on either side.

3.By earlier order of this Court, dated 07.04.2022 the revision petitioner accepted to vacate the premises on or before 21.04.2022. 4.Today, when the matter is taken up for hearing, the learned counsel appearing for the respondent submitted that the revision petitioner has not vacated the premises till now. https://hcservices.ecourts.gov.in/hcservices/ 1/2

5.In view of the non-compliance of the order passed by this Court, dated 07.04.2022, this Civil Revision Petition stands dismissed by confirming the order, dated 28.07.2020 in R.C.A.No.13 of 2019 passed by the learned Rent Control Appellate Authority (Principal Subordinate Judge), Tirunelveli, reversing the order, dated 03.06.2019 in R.C.O.P.No.17 of 2016 passed by the learned Principal Rent Controller (Principal District Munsif Court), Tirunelveli. The learned counsel for the respondent is to take Contempt proceedings against the revision petitioner, if so advised. No Costs. Consequently, connected miscellaneous petition is closed.
