For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in C.C.No. 280/2019 on the file of the Principal District and Sessions Court for EC and NDPS Act Cases, Madurai in connection with Crime No.41 of 2018. ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner is accused of having committed the offences under sections 8(c), 20(b)(ii)(c), 25 of the NDPS Act, in Crime No.41 of 2018 on the file of the respondent police. He was facing trial in C.C.No.280 of 2019 seeks anticipatory bail.

3. This petition for anticipatory bail has been filed on the premises that non-bailable warrant has been issued against him. 4.The learned Government Advocate points out that the petitioner was originally arrested and that he was granted bail by this Court, but without taking into account the limitations set out under Section 37 of the NDPS Act. CRL OP(MD). No.1333 of 2020 cancellation of bail was moved in Crl.M.P.(MD)Nos.4155 and 4166 of 2018 in Crl.O.P.(MD)No. 8729 of 2018 and the same was allowed by this Court. When the bail granted in favour of the petitioner was cancelled, the petitioner is obliged to surrender. He cannot maintain a petition for anticipatory bail. This petition is patently not maintainable.
