for grant of REV-114 Legal Heirship Certificate, namely TN-720250929136 dated 29.09.2025, on the file of the 3rd respondent, and TN-720251119569 dated 19.11.2025, on the file of the 4th respondent, quash the same as illegal and arbitrary, and consequently direct the 3rd or 4th respondent to issue the Legal Heirship Certificate in favour of the petitioner, his father Sanmugam, and his brother S.Tamilarasan, in respect of the petitioner deceased mother Vasanthamani, within the time stipulated by this Court. ORDER

The present writ petition has been filed seeking to quash the order passed by the 3rd and 4th respondents herein wherein the request of the petitioner for issuance of the legal heir certificate has been rejected.

According to the learned Counsel appearing for the writ petitioner his mother, namely, Vasanthamani, who was working in Somanur Area, Palladam Taluk, was admitted to a hospital at Coimbatore and she had passed away on 20.02.2007 and the death certificate was issued on 16.05.2007 wherein the permenant address of the deceased is mentioned as Palladam Taluk. 2/6

The learned Counsel appearing for the petitioner further submits that when the petitioner had approached the 4th respondent seeking legal heir certificate, it has been rejected on the ground that the deceased person was working in Tiruppur District but she is a permanent resident of Dindigul District. Thereafter, the petitioner had approached the third respondent who has also rejected, relying upon the death certificate that the deceased person is permenant resident of Tiruppur District. Hence, the present writ petition.

A perusal of the records reveal that the deceased person, namely, Vasanthamani, was a permanent resident of Dindigl District and her name is found in the family card which was issued for the period covering 2005 and 2009 to the effect that she is residing at Kongapatti, Boduvarpatti Village, Ottanchathiram Taluk, Dindigul District. Therefore, the third respondent would have jurisdiction to entertain the request for issuance of the legal heir certificate.

5. In view of the above said facts, this Court is not inclined to interfere in the order of the 4th respondent herein. However, the order of the 3rd respondent is set aside and the matter is remitted back to the file of the 3rd respondent to consider the request of the petitioner and pass orders on merits and in accordnace with law within a period of 4(four) weeks from the date of receipt of 3/6

a copy of this order.

6. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed. 22.01.2026 NCC :yes/No Index :yes/No Internet:yes/No RJR 4/6
