CMP.(MD).No.539/2026 in SA.(MD).No.84/2007 N.MALA, J.

This petition is fled to substitute the petitioners 7 and 8 as proposed appellants in the place of appellants 1 to 6 in the Second Appeal.

2.The proposed petitioners state that the suit was filed in the representative capacity as per the Village Resolution by the original appellants in the Second Appeal. The original appellants in the Second Appeal died pending appeal and therefore, by a Resolution of the villagers, it was decided to appoint the proposed petitioners as appellants 7 and 8 to prosecute the Second Appeal. The proposed petitioners state that if the petition is not allowed, great prejudice would be caused to the appellants/petitioners and on the contrary, no prejudice would be caused to the respondents.

3.Being satisfied with the aforesaid reasons, the petition is allowed.

4.The Registry is directed to carry out necessary amendment in the cause title by substituting the petitioners 7 and 8 as appellants in the Second Appeal in the place of original appellants 1 to 6.

5.Post the Second Appeal for hearing after carrying out the amendment as aforesaid.
