For Respondent : Mr.S.MANIKANDAN, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 10 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 of IPC, seeks anticipatory bail.

2.The case against the petitioner is that the first accused had illegally transported two units of gravel sand by using JCB, without any valid license. Hence, the complaint.

3.On the side of the petitioner, it is stated that the petitioner was not present in the scene of occurrence and he is only an owner of the JCB and prayed the petitioner to be released on anticipatory bail.

4.On the side of the respondent, it is stated that totally three persons involved in the occurrence. Co accused was arrested and released on bail and the petitioner is arrayed as A3 in this case and he is the owner of the JCB. It is fairly admitted that the petitioner is having no previous case.

5. In view of the submissions made by both parties and considering the fact that there is no bad antecedents against this petitioner and the co-accused was already released on bail, this https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.1263 of 2022 Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or his appearance, before the learned Judicial Magistrate, Musiri, and on his executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.30 am until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
