O R D E R

The quash petition has been filed by the petitioners seeking to quash the F.I.R in Crime No.218 of 2012 on the file of the Inspector of Police, Kadayam Police Station, Tirunelveli District.

2. It is seen that the alleged offence attributed against the petitioners is under Sections 294(b), 323, 506(i) of the Indian Penal Code. When the matter is taken up for hearing, the petitioners and the second respondent appeared in person and their presence is also noted by this Court and the learned counsel appearing for the petitioners and the learned counsel appearing for the second respondent filed a memo of compromise stating that since the matter has been compromised, the second respondent agreed to withdraw the above said case in Crime No.218 of 2012 on the file of the Inspector of Police, Kadayam Police Station, Tirunelveli District. The second respondent has also filed an affidavit to that effect stating that he has no objection to quash the F.I.R. The identity of the petitioners and the second respondent was identified by their ration card, aadhar card and driving licence.

3. Considering the nature of allegation and also considering the memo of compromise filed by the petitioners and the second respondent, this Court is inclined to quash the F.I.R pending against the petitioners. https://hcservices.ecourts.gov.in/hcservices/

Accordingly, this Criminal Original Petition is allowed and the F.I.R in Crime No.218 of 2012 on the file of the Inspector of Police, Kadayam Police Station, Tirunelveli District is hereby quashed.
