PETITION FOR BAIL Under Sec. 439 Cr.P.C.
ORDER : The Court Made the following order :- In Crl.O.P.(MD).Nos.15268 and 15269 of 2015, the petitioner in both cases, who is arrayed as A3, in Crime Nos.39 and 40 of 2015 respectively, on the file of the respondent police was arrested and remanded to judicial custody on 21.06.2015 for the alleged offence punishable under Sections 457 & 380 of I.P.C, and 452 & 392 of IPC respectively, and hence the petitioner in both cases, seeks bail.
2. The case of the prosecution is that on 19.02.2015, during night hours, the petitioner in both cases along with other accused persons trespassed into the defacto complainant's house and broken and locker, snatched 11⁄2 sovereigns of gold ear-ring and 1⁄2 sovereigns of gold ring.
3.The learned counsel for the petitioner in both cases submitted that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution.
4. Heard the learned Government Advocate (Crl. Side) appearing for the respondent in both cases.

5. Considering the submissions and contentions made by both side and also considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner in both cases, with certain conditions.
6. Accordingly, the petitioner in both cases is ordered to be released on bail on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Virudhunagar and on further condition that the petitioner in both cases shall stay at Villupuram and appear before the Inspector of Police, Villupuram Town Police Station, daily at 10.00 a.m. and 6.00 p.m until further orders.
