Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/A2 apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 408 and 420 IPC in Crime No.597 of 2014 on the file of the respondent police and hence, seeks anticipatory bail.

2.Earlier application for anticipatory bail of this petitioner in Crl.O.P.(MD) No.23878 of 2014 was dismissed observing the confession statement of Ponraj, who had defalcated several lakhs of rupees, purchased properties in the name of this petitioner. 3.The learned counsel for the petitioner submitted that the earlier application was dismissed on the premise that all the accused are employees of the de-facto complainant, which is nor correct and the second accused was implicated as he is a relative of the first accused. 4.The learned Government Advocate (Crl. Side) would submit that the earlier application was dismissed on merits holding that the petitioner was not entitled for anticipatory bail and there is no change of circumstance to consider this application now. 5.

Considering the fact that the earlier application of this petitioner was dismissed observing that he is not entitled to the relief of anticipatory bail, this Court is not inclined to grant the relief of anticipatory bail and hence, this Criminal Original Petition is dismissed. sd/- 10/08/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
