PRAYER :- For Bail in Crime No.270/2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 31.12.2022 for the offence punishable under Section 392 of IPC in Crime No.270 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 11.07.2022 at about 7.00 pm., when the defacto complainant was returning to her home, the accused persons snatched 44 grams of gold chain from the defacto complainant, hence the case.
3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. He would further submit that the petitioner is in judicial custody from 31.12.2022, hence he seeks bail.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that it is a case of chain snatching. He would further submit that the petitioner along with other accused snatched the gold chain of the of the defacto complainant. He would https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.1209 of 2023 further submit that the petitioner was arrested only on 31.12.2022 and the finger print of the petitioner has been taken and has been sent for comparison to the State Crime record Bureau and thereby he would oppose for grant of bail.
5. Heard. Perused the materials available on record including the First Information Report.
6. Taking into consideration of the facts and circumstances of the case and also the submission made by the learned Additional Public Prosecutor this Court is not inclined to grant bail to the petitioner.
7. Hence the Criminal Original Petition stands dismissed for the present.
