BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 21.11.2025
CORAM:
THE HONOURABLE MS.JUSTICE P.T.ASHA and W.M.P(MD)No.1174 of 2023 R.Rupa .. Petitioner Vs.
1.The Assistant Engineer, Tamil Nadu Generation and Distribution Corporation Ltd, Pattukottai, Thanjavur District.
2.M.Punitha 3.Murugesan .. Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the 1st respondent to provide New Electricity Connection in Application No. 2000644211221190 of electricity supply to the Petitioner's property situated in Old Survey No.70/1, New Survey No. 70/7, Pattukkottai Town, Pattukkottai Taluk, Thanjavur District. For Petitioner : Mr.N.Balasubramanian
For R1 : Mr.M.Viji for Mr.K.Nagarajan For R2 : Mr.P.Thirumahilmaran
ORDER
The request of the petitioner to provide electricity connection to his property situate in Old Survey No.70/1, New Survey No. 70/7, Pattukkottai Town, Pattukkottai Taluk, Thanjavur District is the subject matter of this writ petition.
2. It is the case of the petitioner that the property in question originally belonged to one Thiruppathy and under a Will dated 11.03.2016, the said Thiruppathy had bequeathed the property in favour of the 2nd respondent and her two sons. The 2nd respondent and her minor sons had come forward to sell the property to the petitioner herein and a registered sale deed dated 12.01.2021 was executed on the file of the Sub Registrar, Pattukkottai by the 2nd and the 3rd respondents as the guardian of the minor sons. However, in the document, the date was wrongly mentioned as 12.01.2020 which is a typographical error. However,
respondents 2 and 3 are attempting to take advantage of this error and had moved a petition before the District Registrar, Pattukottai to cancel the document. This despite the fact, they had given a no objection for issuing the patta in favour of the petitioner.
3. While so, the petitioner had applied for electricity connection before the 1st respondent which is kept pending on account of the objection of the 2nd respondent. Therefore, the petitioner has come forward with the present writ petition.
4. The learned Standing Counsel has submitted a communication received from the Assistant Electrical Engineer, (Operation & Maintenance) enclosing the applications, the documents of the parties and a photograph. A perusal of the photograph would show that the electricity service connection is sought for a room which is abutting the main house. This Court is at loss to understand as to why a separate service connection is required for a room when a mere electric line could be drawn from the main house, particularly when there is already a
dispute with reference to the property in question. Admittedly, the petitioner has a service connection in respect of the main house adjacent to which the room is situate. Therefore, the request of the petitioner for a separate service connection need not be considered as it is well open to the petitioner to draw a line from the main house.
5. Therefore, this Writ Petition stands dismissed. No costs. Consequently, connected Miscellaneous Petition is closed. 21.11.2025 NCC : Yes/No Index : Yes/No Internet : Yes gbg To The Assistant Engineer, Tamil Nadu Generation and Distribution Corporation Ltd, Pattukottai, Thanjavur District.
