Respondents Prayer : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 to 6 to take immediate action to complete the over bridge work (Reconstruction of railway over bridge at KM 0.2 of MSP Camp Road, Near Tiruchi Railway including the railway over bridge Jn. in lieu of existing old bridge No.1136 at railway Km 340/4-5 in between Tiruchi and Poongudi Railway stations) by evolving an alternate design as suggested and stop the waste of public money forthwith and further be pleased to direct the respondents 1 to 6 to deposit in the Treasury of Government of Tamilnadu the cost of the delay and increased budget as they are responsible for this blatant visible unwise fiasco and establish accountability for the waste of public money and it is further prayed that the cost of the litigation Rs.25,000/- be imposed on the respondents payable to the petitioner.

(Order of the Court was made by M.S.RAMESH, J.) The prayer in the present writ petition has become infructuous, since the overbridge work (Reconstruction of railway overbridge at KM 0.2 of MSP Camp Road, Near Tiruchi Railway, including the railway overbridge Page No.2 of 5
Junction, in lieu of existing old bridge No.1136 at railway Km 340/4-5 in between Tiruchi and Poongudi Railway stations), has completed and the bridge has also been put to public use.

The reason assigned by the respondents for the delay in completing the work is that the permission of the Ministry of Defence was required to be obtained, which had delayed the project, apart from the delay consumed in the land acquisition process.
