Respondents Prayer: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 praying to direct the respondent No.2 to file the final report in Crime No.285 of 2013 dated 02.10.2013 on the file of the respondent No.2 for the offences under Sections 452, 294(b), 342, 323, 324, 506(ii) and 380 NH of the Indian Penal Code and also under Section 3 of TNPPDL Act and proceed with the same as per law.

ORDER

The petitioner has come forward with this petition seeking for a direction, directing the second respondent to investigate the matter in Crime No.285 of 2013, which was registered on 02.10.2013 for the offences under Sections 452, 294(b), 342, 323, 324, 506(ii) and 380 NH of the Indian Penal Code and also under Section 3 of TNPPDL Act and to file a final report.

2. The learned counsel for the petitioner would submit that a case in Crime No.285 of 2013 has been registered on the basis of the complaint given by the petitioner on 02.10.2013 for the offences punishable under Sections 452, 294(b), 342, 323, 324, 506(ii) and 380 NH of the Indian Penal Code and also under Section 3 of TNPPDL Act. He would further submit that the respondent has not taken any steps to complete the investigation and file the final report. Hence, the petitioner has come up with the present petition for the relief as stated above.

3. At this juncture, the learned Government Advocate (Criminal Side) would submit that the investigation is going on and the respondent wants one month time to complete the investigation and file the final report.

4. Considering the rival submissions made on either side and also considering the fact that the case has been registered on 02.10.2013 for the offences punishable under Sections 452, 294(b), 342, 323, 324, 506(ii) and 380 NH of the Indian Penal Code and also under Section 3 of TNPPDL Act, the second respondent is directed to complete the investigation in connection with the case in Crime No.285 of 2013 and file the final report, within one month from the date of receipt of a copy of this order.

5. The Criminal Original Petition is disposed of with the above direction.
