... Respondent/Complainant For Petitioner : M/s.S.Pooranachandran, Advocate For Respondent : M/s.S.S. Madhavan Government Advocate (Crl.Side) PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No.1682/2018 on the file of the Respondent Police.

ORDER : The Court made the following order :- The case was registered against the petitioner / A6 for the offences under Sections 147, 148, 341, 302 and 506(ii) IPC. The case was taken cognizance in S.C.No.306 of 2019.

2. According to the petitioner due to his ill health he was unable to appear before the trial Court on 10.01.2021 and hence, Non Bailable Warrant was ordered against him. Pursuance to Non Bailable Warrant issued he was arrested and remanded to judicial custody on 18.11.2021.

3. The learned Government Advocate (Crl. Side) would submit that this Court by order dated 15.12.2021 dismissed the earlier bail petition filed by the petitioner with a direction to complete the https://hcservices.ecourts.gov.in/hcservices/

trial proceedings as expeditiously as possible preferably within a period a period of three months from the date of receipt a copy of that order. He would further submit that the petitioner is not cooperating with the trial Court to complete the trial.

4. The learned counsel appearing for the petitioner would submit that in view of the present pandemic situation there is no possibility to complete the trial process as directed by this Court. He would further submit that the petitioner undertakes to appear before the trial Court.

5. After the lapse of one year, I do not find any merit in this petition. However, In view of the undertaking given by the petitioner, the trial Court is directed to complete the trial proceedings within a period of three months from today.

6. With the above observation, the Criminal Original Petition is dismissed.
