Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue Writ of Certiorarified Mandamus, calling for the records in Na.Ka.No.04/MIKE/CAMP/2021 dated 20.02.2021 passed by the first respondent and quash the same and consequently direct the respondents to give permission and protection to conduct Kabadi Tournament scheduled to be held on 13.02.2021 and 14.02.2021 at Devipattinam Village, Sivagiri Taluk, Tenkasi District. ORDER
By consent, this Writ Petition is taken up for final hearing at the admission stage itself.
2. The petitioner has filed this petition seeking permission to conduct Kabadi Tournament on 13.02.2021 and 14.02.2021 at Devipattinam Village, Sivagiri Taluk, Tenkasi District.
3. Mr.R.Saravana Kumar, learned Government Advocate (Criminal Side), who accepts notice on behalf of the respondents, on instructions, would contend that the petitioner's representation dated 18.01.2021 was rejected by the first respondent citing the present Covid-19 pandemic situation. However, he would submit that since certain relaxations are made by the Government in the subsequent Government Orders, they are ready to consider the fresh representation, if submitted by the petitioner.
4. Considering the said submissions made by the learned Government Advocate (Criminal Side), the petitioner, if so advised, can file a fresh petition before the District Collector, Tenkasi District and on receipt of the same, the District Collector shall consider and pass appropriate orders on merits and in accordance https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD)No.1808 of 2021 with law within a period of two weeks from the date of receipt of the representation of the petitioner.
5. With the above observation, this petition is disposed of. No costs.
