ORDER : The Court Made the following order :- The petitioner, who is arrayed as A4, in Crime No.62 of 2010 on the file of the respondent police apprehends arrest in pursuant to the Non Bailable Warrant issued on 29.03.2014, by the learned Principal Assistant Sessions Judge, Thanjavur, in S.C.No.300 of 2012, for the offences under Sections 147, 148, 149 and 506(ii) IPC r/w Section 3(1) of PPDL Act and Section 25 of Arms Act, and hence, seeks anticipatory bail.

2. The learned counsel for the petitioner submitted that the case was registered in the year 2010 and the petitioner is regularly appearing before the trial Court and due to ill-health he did not appear before the Court on the date of hearing and therefore, non bailable warrant was issued. He further submitted that the petitioner undertakes to appear before the trial Court for all future hearings without fail.

3.The learned Government Advocate (Crl.side) would submit that due to pendency of NBW there is no progress in the trail.

4. Considering the facts and circumstances of the case this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Principal Assistant Sessions Judge, Thanjavur, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judge concerned and on further condition that the petitioner shall appear before the trial Court for all hearing dates without fail. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioner shall appear before the concerned Judge within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
