PRAYER: Criminal Original Petition filed under Section 482 of Code of Criminal Procedure, to pass an order to complete the trial in STC No.295 of 2016 pending on the file of Judicial Magistrate Court No.I, Fast Track Court at Magisterial Level, Madurai within a stipulated period of time.

ORDER

This petition has been filed by the petitioner to direct the learned Judicial Magistrate Court No.I, Fast Track Court at Magisterial Level, Madurai, to dispose of STC No.295 of 2016 at the earliest.

2.The learned counsel for the petitioner has submitted that based on the compliant filed by the petitioner herein a case was taken on file in STC No.295 of 2016 on the file of the Judicial Magistrate Court No.I, Fast Track Court at Magisterial Level, Madurai, for the offence under Section 138 of the Negotiable Instruments Act. He further submitted that the above case is pending from the year 2016, but, so far, the case has not been disposed of and hence, direction may be given to the trial Court to dispose of the said case at the earliest.

3.A Perusal of the diary extract shows that on most of the hearings the accused has not appeared and he has filed petitions under Section 317 Cr.P.C and hence, the case has been adjourned routinely. Further it appears that for cross examination of the P.W.1 the case has adjourned for several hearings and now the learned counsel for the petitioner has submitted that the trial Court has closed the cross examination of P.W.1 and posted for further evidence on the side of the complainant. https://hcservices.ecourts.gov.in/hcservices/ 4.Considering the aforesaid facts, the Judicial Magistrate

Court No.I, Fast Track Court at Magisterial Level, Madurai, is directed to expedite the trial and dispose of the STC No.295 of 2016 within a period of three months from the date of receipt of a copy of this order.

4.With the aforesaid submissions, this Criminal Original Petition is disposed of.
