ORDER
This Criminal Original Petition has been filed to direct the second respondent to register a case based on the complaint given by the petitioner dated 06.01.2018.
2.The learned counsel appearing for the petitioner has submitted that one Pavanantham Premohan introduced himself that he has citizenship of Canada and running a Man Power Agency from 2007 onwards. He further submitted that the said Pavanantham Premohan induced the petitioner to collect money from 51 persons, who are searching for job and accordingly, the petitioner has collected a sum of Rs.15,30,000/- from 51 persons and paid the same to the said Pavanantham Premohan, but, subsequently, he did not make any arrangement for job to the aforesaid persons. Hence, the petitioner has lodged a complaint before the first respondent on 06.01.2018 and the same is forwarded to the second respondent, but, sofar, no action has been taken.
3.The learned Government Advocate (Crl.side) has submitted that the second respondent, after receipt of the complaint through the first respondent, has conducted an enquiry and found that the petitioner herein also involved in job racketing and however, the complaint is still pending for enquiry with the second respondent. https://hcservices.ecourts.gov.in/hcservices/
4.Considering the aforesaid submissions, the second respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence then, he has to register a case and proceed further in accordance with law. If the enquiry reveals that the petitioner is also involved in this case, there is no bar to proceed against the petitioner also.
5.With the aforesaid observations, this Criminal Original Petition is disposed of.
