This petition has been filed to condone the delay of 778 days in filing the above appeal.

2. Notice has been served on the second respondent / Insurance Company and Mr.Sakthivel, takes notice for the second respondent.

3. Notice sent to the first respondent has been returned as un-served.

4. It is seen that the first respondent remained ex-parte before the Tribunal.

Hence, notice is dispensed with for the first respondent.

5. Heard both sides.

6. Considering the reasons stated in the affidavit filed in support of the petition, this petition is allowed and delay is condoned.

7. It is made clear that the petitioner will not be entitled to claim any interest for the delay period.

8. Registry is directed to number the appeal, if it is otherwise in order and list the same for admission and while listing, name of the second respondent's counsel shall be printed in the cause title.
