ORDER

This petition has been filed to direct the third respondent to register a case based on the complaint given by the petitioner, dated 03.02.2018.

2.The learned counsel for the petitioner has submitted that the petitioner is a building contractor and he entered into a contract with the proposed accused for constructing his house for a sum of Rs.23,27,000/- and initially the proposed accused paid only a sum of Rs.6,77,000/-. Even after completion of the building, the proposed accused did not pay the balance amount of Rs.13,27,000/- and he refused to pay the balance amount. Hence, a complaint has been lodged, but sofar, no action has been taken. 3.The learned Government Advocate (Crl.side) has submitted that enquiry is still pending.

4.Considering the aforesaid submission, the third respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence, then he has to register a case and proceed in accordance with law.

5.With the aforesaid submission, this Criminal Original Petition is disposed of.
