Heard the learned counsel on either side.

2.The petitioner seeks issuance of passport. It is true that the petitioner was involved in a criminal case. When the matter was taken up for hearing, the learned Government Advocate clarified that the case has been referred as mistake of fact. Therefore, there is no impediment to process the petitioner's application.

3.The first respondent is directed to process the petitioner's application and issue passport to him as expeditiously as possible, subject to fulfilment of the other usual formalities. 4.Accordingly, this writ petition is allowed.
