Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certiorarified mandamus calling for the records relating to the Impugned proceedings in ghh;it /$.r.jpz;L /WP(MD)No.130/2016 dated 05.04.2016 by the 1st respondent and quash the same and consequently directing the 1st Respondent to appoint the Petitioner as Conductor in compassionate appointment.

ORDER

It is stated by the learned counsel for the petitioner that as against the order of the Writ Court, the Transport Corporation has filed an appeal in W.A(MD) No.120 of 2021 and the order of the Writ Court has also been stayed by the Hon'ble Division Bench of this Court on 20.01.2021.

2.While that being so, it would not be appropriate to keep the contempt pending, particularly, when the Hon'ble Division Bench has seized the matter.

However, if the cause of action for filing contempt arises after the disposal of the writ appeal, it is open to the petitioner to do so.
